1. BOOKING & DEPOSIT

Accepted Answer

A 50% deposit is ordinarily required to secure and confirm all bookings. A date will not normally be considered secured until the required deposit has been received. Until payment of the deposit is made, the Artist reserves the right to accept another booking for the same date. The 50% deposit acts as a commitment to the booking and reserves the agreed date and time exclusively for the Client. Where payment of a 50% deposit is not part of a company or organisation’s standard booking or payment procedure, the Artist may, at their discretion, agree to confirm and secure the booking without a deposit. Where a booking is confirmed without a deposit, all other Terms & Conditions remain fully applicable, including cancellation terms and the Client’s obligation to pay any fees that subsequently become due. Confirmation without a deposit does not waive or reduce the Client’s liability under these Terms & Conditions. Payment of a deposit, written confirmation of a booking, or instruction to proceed constitutes acceptance of these Terms & Conditions. The remaining balance must be paid in accordance with the payment terms stated on the booking confirmation or invoice.

2. CANCELLATIONS BY THE CLIENT

All cancellations must be communicated to the Artist as soon as possible. Where a booking is cancelled more than 30 days before the performance date, any 50% deposit paid will remain non-refundable. No further payment will ordinarily be required. Where a booking is cancelled within 30 days of the performance date, 100% of the agreed booking fee will become payable. At the Artist’s discretion, this amount may be reduced in circumstances where the date is successfully rebooked or where the Artist considers a reduction appropriate. Where a booking is cancelled within 14 days of the performance date, 100% of the agreed booking fee will be payable, subject to any rights the Client may have under applicable law. These cancellation terms apply regardless of whether a deposit was required or paid at the time the booking was confirmed. Any decision by the Artist to waive or reduce a cancellation charge on one occasion does not waive the Artist’s right to enforce these Terms & Conditions in relation to any other booking.

3. OUTSTANDING & LATE PAYMENTS

All invoices must be paid within the payment terms stated on the relevant invoice. Where a Client has outstanding or overdue invoices relating to previous performances or services, the Artist reserves the right to suspend services and/or withdraw from any subsequent bookings with that Client until all outstanding amounts have been paid. The Artist is under no obligation to continue providing further performances or services to a Client who has failed to make payment for previous services within the agreed payment terms. Where the Artist withdraws from a future booking as a direct result of the Client’s failure to pay an overdue invoice, this will be treated as a Client default rather than a voluntary cancellation by the Artist. The Client will remain liable for any cancellation charges applicable to the future booking under these Terms & Conditions. Where the withdrawal takes place within 30 days of the performance, this may include the full agreed booking fee. Where the withdrawal takes place within 14 days of the performance date, the full agreed booking fee will remain payable, subject to applicable law. Payment of the outstanding invoice does not automatically guarantee that a future booking which has already been suspended or cancelled will be reinstated. Reinstatement will be at the Artist’s discretion and subject to availability.

Question 4

4. FINAL BALANCES & PAYMENT

Unless otherwise agreed in writing, all outstanding balances must be paid within the payment period specified on the relevant invoice. The Client is responsible for ensuring payment is made by the due date. Where a company or organisation operates its own payment schedule, this must be communicated and agreed with the Artist when the booking is made. The Artist reserves the right to require outstanding balances to be settled prior to performing where previous payment terms have not been adhered to.

5. CANCELLATION BY THE ARTIST

In the unlikely event that the Artist is unable to fulfil a booking due to serious illness, injury, emergency or circumstances genuinely beyond their reasonable control, the Client will be notified as soon as reasonably possible. Where appropriate, any amounts already paid for services that cannot be provided will be refunded. The Artist will not be responsible for additional or consequential costs incurred by the Client as a result of circumstances genuinely outside the Artist’s reasonable control. This provision does not apply where the Artist suspends or withdraws services as a consequence of the Client’s breach of these Terms & Conditions, including failure to pay outstanding or overdue invoices.

Question 6

6. CHANGES TO A BOOKING

Accepted Answer

Any significant changes to the agreed booking must be discussed with and approved by the Artist in advance. This includes changes to: the performance date or venue;arrival or performance times;the duration of the booking;the number or length of performance sets;the nature of the performance or services required; orany significant logistical requirements. Changes may result in an adjustment to the agreed fee, particularly where additional performance time, travel, waiting time or substantially different arrangements are required. A request to move a booking to another date is subject to the Artist’s availability and is not automatically considered an alternative to cancellation.

7. PERFORMANCE TIMES & DELAYS

Accepted Answer

The Artist will make reasonable efforts to accommodate minor changes or delays to the event schedule. Where substantial delays outside the Artist’s control result in additional waiting time or require the Artist to remain at the venue significantly beyond the originally agreed booking period, an additional fee may be charged. Where the Client or venue causes a delay that prevents the Artist from completing the full agreed performance within the original booking period, the full booking fee will remain payable.

8. VENUE & PERFORMANCE REQUIREMENTS

Accepted Answer

The Client is responsible for ensuring that the venue permits live music and that all necessary permissions have been obtained prior to the performance. The Client must inform the Artist in advance of any relevant venue restrictions or requirements, including: sound limiters or noise restrictions;access restrictions;parking or unloading arrangements;required arrival or soundcheck times;restrictions regarding equipment; andany other information that could reasonably affect the performance. The Client must provide reasonable access to the venue to allow sufficient time for unloading, set-up and soundcheck where required.

9. EQUIPMENT

Accepted Answer

Unless otherwise agreed, the Artist will provide the equipment required for their own performance. The Client and/or venue must provide a safe and appropriate electrical supply and a suitable performance area. The Artist will not be held responsible for an inability to perform or interruption to a performance caused by unsuitable venue facilities, loss of electricity, venue equipment failure or circumstances outside the Artist’s reasonable control.

10. OUTDOOR PERFORMANCES

Accepted Answer

Where a performance is taking place outdoors, the Client must provide a safe, suitable and adequately sheltered performance area. The Artist and all electrical and performance equipment must be appropriately protected from rain, excessive heat and other unsuitable weather conditions. The Artist reserves the right to delay, suspend or refuse to perform where weather or other conditions present a reasonable safety risk to the Artist, equipment or others. Where the Artist is unable to perform because the Client or venue has failed to provide a reasonably safe and suitable environment, the agreed booking fee will remain payable.

11. TRAVEL, PARKING & ADDITIONAL EXPENSES

Accepted Answer

Any agreed travel or accommodation charges will be outlined within the quotation, booking confirmation or invoice. Unless otherwise agreed, reasonable parking charges, congestion charges, tolls or similar expenses directly associated with fulfilling the booking may be payable by the Client. Where circumstances change after confirmation and result in substantial additional costs that could not reasonably have been anticipated when the booking was made, these will be discussed with the Client wherever reasonably possible.

12. CONDUCT & SAFETY

Accepted Answer

The Artist reserves the right to stop, suspend or refuse to continue a performance where they experience threatening, abusive, dangerous or seriously inappropriate behaviour. The Artist also reserves the right to stop performing where continuing would present a reasonable risk to their health, safety or equipment. Where a performance is stopped or cannot reasonably continue because of circumstances caused by the Client, venue, guests or attendees, the full agreed booking fee will remain payable.

13. FORCE MAJEURE

Accepted Answer

Neither the Artist nor the Client will be held responsible for failure to fulfil contractual obligations where this is prevented by exceptional circumstances genuinely beyond their reasonable control. Such circumstances may include severe weather, natural disasters, government restrictions, serious transport disruption, venue closure or other exceptional events that could not reasonably have been prevented. Where such circumstances occur, postponement, rescheduling, cancellation and any amounts payable or refundable will be considered according to the individual circumstances, including any costs already reasonably incurred.

14. ACCEPTANCE OF TERMS

Accepted Answer

By paying a deposit, confirming a booking in writing, accepting a quotation, or otherwise instructing the Artist to proceed with a booking, the Client confirms that they have read, understood and accepted these Terms & Conditions.
